TERMS OF SERVICE

These Terms of Service govern your use of the Motylek Merch online store and your purchase of products from us. By visiting the store or placing an order, you agree to these Terms, our Privacy Policy, Shipping Policy, and Return and Refund Policy. Nothing in these Terms limits consumer rights that cannot legally be waived.

1. STORE AND ELIGIBILITY
Motylek Merch operates this online store using Shopify. You must be legally able to enter into a binding agreement in your place of residence to make a purchase. You are responsible for providing accurate, current, and complete account, billing, payment, and shipping information.

2. PRODUCTS
Our products are made to order. We make reasonable efforts to display product colors, dimensions, and other details accurately, but appearance may vary by screen and minor production variations may occur. Product descriptions, prices, availability, and designs may be changed or discontinued without notice.

3. ORDERS
Submitting an order is an offer to purchase. We may accept, decline, limit, or cancel an order for reasons including suspected fraud, pricing or listing errors, product availability, intellectual-property concerns, or shipping restrictions. An order is accepted when we confirm acceptance or begin fulfillment. Because products are made to order, changes or cancellations may not be possible once production begins.

4. PRICES, TAXES, AND PAYMENT
Prices are shown in the currency displayed at checkout. Shipping charges, taxes, duties, and other applicable charges are shown or calculated at checkout when available. You agree to pay all charges associated with your order using an authorized payment method. Payment processing is handled by third-party providers and may be subject to their terms.

5. SHIPPING AND DELIVERY
Orders are shipped according to our Shipping Policy. Processing and delivery dates are estimates, not guarantees. Carrier delays, customs processing, weather, incorrect addresses, and events outside our reasonable control may affect delivery. Tracking is provided when available. Risk of loss transfers only as permitted by applicable law.

6. RETURNS, REPLACEMENTS, AND REFUNDS
All sales are final except where required by law or as stated in our Return and Refund Policy. Approved claims for items badly damaged or destroyed in transit are generally resolved with a replacement, subject to review and availability. Please review the Return and Refund Policy before purchasing.

7. INTELLECTUAL PROPERTY
The store content, artwork, product designs, images, branding, text, graphics, and other materials are owned by or licensed to Motylek Merch and are protected by applicable intellectual-property laws. You may not copy, reproduce, distribute, sell, modify, or commercially exploit store content without prior written permission.

8. ACCEPTABLE USE
You may not use the store or its services for unlawful, fraudulent, abusive, harmful, or unauthorized purposes; interfere with store security or operation; introduce malicious code; scrape or collect information in violation of applicable law; impersonate another person; or infringe the rights of Motylek Merch or any third party.

9. THIRD-PARTY SERVICES
The store may use or link to services operated by Shopify, payment processors, carriers, and other third parties. Those services may have separate terms and privacy practices. Motylek Merch is not responsible for third-party websites or services except to the extent required by law. Purchases from this store are transactions with Motylek Merch, not Shopify.

10. DISCLAIMERS
To the fullest extent permitted by applicable law, the store and products are provided on an “as available” basis. We do not guarantee that the website will always be uninterrupted or error-free. Any warranties that cannot legally be excluded remain in effect.

11. LIMITATION OF LIABILITY
To the fullest extent permitted by applicable law, Motylek Merch will not be liable for indirect, incidental, special, punitive, or consequential damages arising from use of the store or products. Where liability cannot be excluded, it will be limited only to the extent permitted by law. This section does not exclude liability that cannot legally be limited.

12. INDEMNIFICATION
To the extent permitted by law, you agree to indemnify Motylek Merch against third-party claims resulting from your unlawful misuse of the store, your violation of these Terms, or your infringement of another party’s rights.

13. PRIVACY
Personal information is handled according to our Privacy Policy. Shopify and other service providers may process information necessary to operate the store, complete payments, fulfill orders, prevent fraud, and provide customer support.

14. CHANGES
We may update these Terms by posting a revised version on this page. Material changes apply from the stated effective date. Your continued use of the store after an update constitutes acceptance where permitted by law.

15. SEVERABILITY AND ENTIRE AGREEMENT
If any provision is found unenforceable, the remaining provisions remain effective. These Terms and the policies referenced above form the agreement governing use of the store and purchases, except where applicable law provides otherwise.
